By accessing or using the website at www.losbanosinsulation.com (the "Site"), or by engaging Los Banos Insulation to perform insulation services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or our services.
These Terms and Conditions apply to all visitors, leads, and customers of Los Banos Insulation. We may update these terms at any time. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated terms.
Los Banos Insulation provides residential and commercial insulation services in Los Banos, CA and surrounding areas. Services include, but are not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, wall insulation, air sealing, vapor barrier installation, insulation removal, and related work.
All services are subject to the terms of a written estimate or service agreement provided before work begins. Los Banos Insulation reserves the right to decline any project at its discretion.
All estimates provided by Los Banos Insulation are based on the conditions observed during an on-site assessment. Estimates are provided in writing and are valid for 30 days from the date issued unless otherwise stated.
Estimates are based on the scope of work described at the time of assessment. If conditions discovered during the project differ materially from those observed during the estimate - such as hidden moisture damage, pest infestation, unexpected structural conditions, or additional access requirements - we will notify you before proceeding with any work beyond the original scope. Any additional work will be quoted and approved in writing before it is performed.
Los Banos Insulation does not guarantee that written estimates are final until work has been completed. However, we do not perform additional work without your prior approval.
Projects are scheduled by mutual agreement between Los Banos Insulation and the customer. We will make reasonable efforts to honor scheduled dates. However, we reserve the right to reschedule due to weather, crew availability, equipment issues, or other circumstances outside our control.
If you need to cancel or reschedule your project, please notify us at least 48 hours before the scheduled start time by calling (209) 592-1588 or emailing hi@losbanosinsulation.com.
Cancellations made less than 24 hours before the scheduled start time may result in a fee to cover mobilization costs incurred by Los Banos Insulation. The amount of any such fee will be communicated to you at the time of scheduling.
Payment is due upon completion of the project unless otherwise agreed in writing. Accepted payment methods will be specified in your written estimate or service agreement.
For larger projects, Los Banos Insulation may require a deposit before work begins. The deposit amount and terms will be stated in the written estimate.
Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the unpaid balance, or the maximum rate permitted by California law, whichever is less. Los Banos Insulation reserves the right to pursue collection of unpaid amounts through all legal means available.
To allow Los Banos Insulation to complete work safely and on schedule, you agree to:
Failure to meet these responsibilities may result in rescheduling fees or changes to the project scope and cost.
Los Banos Insulation warrants that all work will be performed in a workmanlike manner and in accordance with the specifications in the written estimate. If you are not satisfied with completed work, contact us within 10 business days of project completion and we will work with you to address the issue.
Manufacturer warranties on materials are passed through to you as the customer and are subject to the manufacturer terms. Los Banos Insulation makes no independent warranty beyond the workmanship guarantee stated above.
The Site and its content are provided "as is" without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, Los Banos Insulation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or our services, even if we have been advised of the possibility of such damages.
In no event will the total liability of Los Banos Insulation to you exceed the amount you actually paid to Los Banos Insulation for the specific project giving rise to the claim. Some jurisdictions do not allow limitations on implied warranties or liability for consequential damages, so these limitations may not apply to you.
If a dispute arises between you and Los Banos Insulation related to services performed or these Terms and Conditions, we encourage you to contact us first at hi@losbanosinsulation.com so we can try to resolve it informally.
If informal resolution is not possible, both parties agree to submit the dispute to binding arbitration in Los Banos, CA, under the rules of the American Arbitration Association, before resorting to litigation. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of CA, without regard to conflict of law principles. Any legal action not subject to the arbitration clause above shall be brought exclusively in the state or federal courts located in Merced County, California.
All content on this Site - including text, images, logos, and design elements - is the property of Los Banos Insulation or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from this Site for commercial purposes without our express written permission.
